Open carry is unsettled. The statute banning it is still on the books, but a Florida appeals court held the ban unconstitutional in McDaniels v. State (September 2025), and the Attorney General advised police and prosecutors to refrain from arresting or prosecuting law-abiding citizens for visibly carrying. Unless the statute is repealed or the Florida Supreme Court strikes the ban down, the stricter course is not to carry openly. Courthouses, schools, polling places, some bars and other listed places still restrict guns, property owners can order you to leave, and threatening display is a crime.
