Vermont Consumer Fireworks (2026)
Restricted: Vermont effectively bans consumer fireworks: only sparklers and listed novelties are legal without a permit; firecrackers, Roman candles, and all aerials require a municipal display permit (not a consumer use) (20 V.S.A. 3132).

- MassachusettsRestricted
All consumer fireworks are illegal to sell, possess or use in Massachusetts — the only total-ban state. The ban applies even to fireworks bought legally in another state, so transporting them in is illegal. Unlawful sale carries a $100–$1,000 fine and/or up to one year in jail; unlawful possession or use carries a $10–$100 fine, and seizure is mandatory (M.G.L. c. 148 § 39).

- New HampshireConditional
Consumer fireworks are permitted statewide in New Hampshire by state law, but local option is strong: towns and cities may require a local permit to use them or may ban them entirely (RSA 160-C). Always check the community restrictions list and your local fire department.

- New YorkConditional
In New York, only "sparkling devices" are allowed, and only in counties and cities that have not opted out; all other consumer fireworks are illegal statewide. New York City and several counties — Albany, Bronx, Columbia, Kings, Nassau, New York, Queens, Richmond, Schenectady, Suffolk, Warren and Westchester, plus Middletown and Newburgh — ban even sparklers.
