Legal sparklers and fountains must be non-explosive, non-aerial and no more than 100 g of pyrotechnic mixture. Most fireworks violations are a class C misdemeanor: up to 3 months, $500, or both.

  • MassachusettsRestricted

All consumer fireworks are illegal to sell, possess or use in Massachusetts — the only total-ban state. The ban applies even to fireworks bought legally in another state, so transporting them in is illegal. Unlawful sale carries a $100–$1,000 fine and/or up to one year in jail; unlawful possession or use carries a $10–$100 fine, and seizure is mandatory (M.G.L. c. 148 § 39).

  • New YorkConditional

In New York, only "sparkling devices" are allowed, and only in counties and cities that have not opted out; all other consumer fireworks are illegal statewide. New York City and several counties — Albany, Bronx, Columbia, Kings, Nassau, New York, Queens, Richmond, Schenectady, Suffolk, Warren and Westchester, plus Middletown and Newburgh — ban even sparklers.
