Arkansas sets its DWI limit at an alcohol concentration of 0.08% or more in breath or blood for adults, 0.04% for commercial drivers, and 0.02% for anyone under 21 (an "Underage DUI"). A first DWI conviction carries a fine of $150 to $1,000 plus court costs, up to one year in jail, and a 120-day license suspension. Administrative suspension periods run 6 months for a first offense, 24 months for a second within 5 years, 30 months for a third, and a 4-year revocation for a fourth. Underage offenders can be fined up to $2,000 and lose the license until age 21. Reinstatement requires an alcohol education or treatment program, a victim impact panel, ignition interlock, and a $150 fee (A.C.A. §§ 5-65-103, 5-65-205).
